Welcome to Anagram Arena, brought to you by Vito immortalis d.o.o. ("we," "us," "our"). These Terms of Use ("Terms") govern your use of our Anagram Arena mobile game and related services ("Services"), which are available to players who are at least 13 years old and reside in any country worldwide, except for the following restricted territories: Democratic People's Republic of Korea (North Korea), Iran, Syria, Cuba, Somalia, South Sudan, Eritrea, Central African Republic, and Sudan ("Restricted Countries"). By accessing or using our Services, you confirm that you are at least 13 years old, do not reside in a Restricted Country, and agree to be bound by these Terms. If you do not meet these requirements or do not agree to these Terms, please do not use our Services.
1. Age and Residency Restrictions
- Eligibility: Our Services are intended only for individuals who are 13 years of age or older and reside in any country worldwide, except the Restricted Countries. By using our Services, you confirm that you are at least 13 years old and do not reside in a Restricted Country. We do not knowingly allow users under 13 to access our Services.
- Prohibition for Restricted Countries: Our Services are strictly prohibited for all players residing in the Democratic People's Republic of Korea, Iran, Syria, Cuba, Somalia, South Sudan, Eritrea, Central African Republic, or Sudan. If it is discovered that a resident from a Restricted Country is accessing our Services, their account will be deleted immediately.
- Enforcement: We reserve the right to terminate accounts and delete associated data if we determine that a user is under 13 years old or resides in a Restricted Country. We may use IP address checks or other methods to enforce these restrictions.
2. Account Creation and Security
- Account Responsibility: You are responsible for all activities that occur under your account. We do not store passwords; authentication is handled securely through third-party services. You agree to notify us immediately of any unauthorized access or use of your account at contact@anagramarena.com.
- One Account Per Player: Each player is allowed to create only one account for Anagram Arena, and you may not share your account with others.
3. License to Use Our Services
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Anagram Arena solely through the official Apple App Store or Google Play Store and in accordance with these Terms. This license is void for users in Restricted Countries.
- No Reverse Engineering: You agree not to reverse engineer, decompile, disassemble, or modify any part of the Services or our backend systems running in the cloud.
- No Bots or Unauthorized Software: You may not use any automated means, including bots, scripts, or other software to interact with our game or access our backend. Only the software provided by us through the App Store or Google Play is permitted for accessing our Services.
- No Illegal Copying: You may not copy, distribute, or reproduce any part of the Services in any unauthorized manner.
4. Restrictions on Use
- Prohibited Activities: You may not engage in any activity that:
- Violates these Terms, applicable laws, or the rights of others.
- Circumvents any security or authentication measures.
- Exploits, modifies, or cheats in our game, including any form of hacking, unauthorized access, or data mining.
- Uses our Services in any way that violates any third-party rights, including intellectual property rights.
- Illegal Use: Anyone using our Services in a manner inconsistent with these Terms, including but not limited to players residing in Restricted Countries, is doing so illegally. We reserve the right to delete any account that violates these Terms. This includes, but is not limited to:
- Accessing or using our Services from Restricted Countries.
- Attempting to bypass age or residency restrictions.
- Engaging in activities that are not allowed under these Terms.
5. Intellectual Property
- Ownership: All rights, title, and interest in and to Anagram Arena, including all content, features, designs, code, and technologies, are owned by Vito immortalis d.o.o. or its licensors. This includes, but is not limited to:
- Game Content: All visual elements of the game, such as graphics, artwork, animations, and user interface designs.
- Game Code: The underlying source code and software that make up the game, including any updates or enhancements.
- Audio Elements: All audio components, including sound effects, music, and voiceovers.
- Trademarks and Logos: Any trademarks, logos, and branding associated with Anagram Arena or Vito immortalis d.o.o. (Note: see Disclaimer of Endorsement and Affiliation for third-party trademarks and logos.)
- Patents and Innovations: Any patents or patentable inventions, methods, and technologies used in or related to the game.
- License Restrictions: You may not use, distribute, or exploit any part of our Services for commercial purposes or in any manner inconsistent with the limited license granted under these Terms.
6. Termination and Account Deletion
We reserve the right to suspend or terminate your account and access to the Services at our discretion, without prior notice, if:
- You violate any of these Terms, including but not limited to reverse engineering, illegal copying, or using bots.
- You access our Services from a Restricted Country or if we discover that you are under the age of 13.
- You engage in any illegal activities while using our Services.
Upon termination, all rights and licenses granted to you under these Terms will immediately cease, and we may delete your account and all associated data. If you are under 13, we will delete your account and data as soon as we become aware of your age.
7. In-Game Purchases
- Virtual Items: Anagram Arena may offer in-app purchases, including virtual items, currency, or other goods. These virtual items have no real-world monetary value and cannot be redeemed or exchanged for real money.
- All Sales Final: All in-app purchases are final and non-refundable unless required by applicable law in your jurisdiction.
8. Data Collection and Privacy
We collect and process personal information in accordance with our Privacy Policy. By using our Services, you agree to the collection and use of your data as outlined in the Privacy Policy. We do not knowingly collect personal information from users under 13. If we detect use from a Restricted Country or by a user under 13, we will delete your account and data immediately.
9. Disclaimers and Limitation of Liability
- Disclaimer of Warranties: Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by applicable law.
- Limitation of Liability: To the maximum extent permitted by applicable law, Vito immortalis d.o.o. will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability, so this limitation may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Vito immortalis d.o.o., its affiliates, licensors, and service providers, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.
11. Updates to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and the "Last Updated" date at the top will be revised. By continuing to use our Services after such changes take effect, you agree to the revised Terms.
12. Governing Law and Dispute Resolution
These Terms and any disputes related to your use of our Services will be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law principles, except where prohibited by mandatory local laws in your jurisdiction.
- Jurisdiction: Subject to applicable local laws, any legal dispute or claim arising out of or relating to these Terms or your use of the Services shall be exclusively resolved in the courts of Zagreb, Croatia.
- Dispute Resolution: Subject to applicable local laws, you agree that any disputes arising out of or in connection with these Terms will be resolved by binding arbitration in Zagreb, Croatia, in accordance with the rules of Croatian arbitration institutions. Where mandatory local laws require alternative dispute resolution mechanisms (e.g., consumer protection laws), those mechanisms will apply.
13. Disclaimer of Endorsement and Affiliation
Vito immortalis d.o.o. is an independent entity and is not affiliated with, endorsed by, or in any way connected with Apple Inc., Google LLC, Amazon Web Services (AWS), or any other third parties, unless expressly stated. The use of any third-party names, logos, products, or services in Anagram Arena is solely for identification purposes and does not imply any endorsement or affiliation.
